Sexual Harassment

Kentucky Lawyer for Victims of Sexual Harassment

Under Title VII of the Civil Rights Act, an employer may not fail or refuse to hire, discharge or otherwise discriminate against any individual because of gender. This law applies to all U.S. employers with 15 or more employees; Kentucky's equivalent law applies to all employers with 8 or more employees. If you were discharged or not hired because of your gender, you experienced sexual harassment.

Attorney Pamela Perlman has the experience you need to fight back against your employer. Her reputation for personal service and a strong work ethic ensures she will handle your case effectively. Contact her today to discuss your sexual harassment situation in a free initial consultation.

Types of Sexual Harassment

Sexual harassment comes in many forms, and includes unwelcome verbal or physical conduct, sexual gender based conduct and monetary or physical injury. The categories of sexual harassment are as follows:

  • Quid Pro Quo: An employer makes a sexual advance or request for sexual favors and promises employment/promotion/favoritism or retaliates for refusal of the advance.

  • Hostile environment: Unwelcome sexual conduct interferes with an employee's ability to perform a job, or creates a hostile, intimidating or offensive work environment.

  • Sexual favoritism: If one employee receives benefits by yielding to sexual advances, co-workers may claim they were denied equivalent benefits.

  • Third party harassment: If an employer is aware that an employee has been sexually harassed by other employees OR customers, and the employer was in a position to exercise some degree of control, the employer may be liable to the employee.

Retaliation

Both federal and state laws prohibit an employer from taking any sort of retaliatory action against an employee who reports harassment.
